America’s Health Rankings API Terms & Conditions

In addition to the America’s Health Rankings (“AHR”) website Terms of Use and Privacy Policy, the use of this API and the data it provides is subject to the following additional terms below (“API Terms”) between the API user (also “you” or “your”) and United Health Foundation (also “we,” “us,” and “our”). Capitalized terms used in these API Terms but not defined herein shall have the meaning ascribed to such terms in the Terms of Use and Privacy Policy.

Registration Required

You must register on the America’s Health Rankings developers website to obtain an API key before using this API. There is no cost to register. By using the API, you agree to these API Terms in addition to the AHR website Terms of Use and Privacy Policy. For purposes of clarity, the API is considered an “Online Service,” and the data provided through the API is considered “Content” under the website Terms of Use and Privacy Policy. In the event of a conflict between the website Terms of Use and Privacy Policy, these API Terms control.

Limited License to Use the API and Data

We hereby grant to you a limited, non-exclusive, non-transferable, non-sublicensable, fully revocable upon notice license to: (a) access and use the application programming interface (“API”) and associated documentation made available by us; (b) access, query, and retrieve the data made available by us via the API or otherwise provided under these API Terms; and (c) use the API and data exclusively for Licensee’s internal and non-commercial business purposes (“Approved Use”). You acknowledge that the API and data are licensed, not sold, and that, except for the limited rights expressly granted herein, no rights, title, or interest in or to the API or data are conveyed. Access to data via the API shall not be deemed delivery of a dataset. You may generate reports, analyses, or other outputs derived from the access to the API and the data solely for the Approved Use; provided that such items: (i) do not, in any way, expose, disclose, or permit reconstruction of the data; and (ii) comply with all restrictions set forth in these API Terms.

Attribution Required

You must attribute America’s Health Rankings as the source of the data in any publications, reports, or other work using the data. You must include the dataset version number with the attribution to ensure transparency regarding the version of the dataset used. In some cases, additional attribution may be required for the underlying source(s) of the data. The data may originate from third-party sources, and information or metadata about the third-party sources will be available within the API itself. If you choose to use the data, you are solely responsible for complying with the applicable data source’s data use and attribution requirements. Rate Limits

Usage of the API is subject to rate limits. Rate limits are in place to help ensure API access for all users and stable performance of the API. We may adjust rate limits as needed to support these objectives.

No Warranty

The API and data are provided "as is" without warranty of any kind. We disclaim all warranties, express or implied. No warranty is provided regarding the API, data, or any applications or results of use of the API or data. Users assume all risk for selection and use of the API and data.

Indemnification

You will defend, indemnify, and hold the United Health Foundation and our Affiliates harmless from any claims, losses, liabilities, and expenses arising from or relating to your use of the API and data.

Termination

We may terminate your access to the API at any time for any reason. All terms will survive termination. We reserve the right in our sole discretion to terminate access to anyone at any time.

Right to Audit

We reserve the right to audit or review your use of the API and data at any time to verify your compliance with these API Terms or the website Terms of Use and Privacy Policy. You agree to cooperate with any such audit and to provide reasonable access to information, records, and materials related to your use of the API and data as may be requested by us. If an audit reveals non-compliance, we may, in our sole discretion, take any action we deem appropriate, including suspension or termination of your access to the API and data. You represent and warrant that you will take all reasonable actions requested by us to address issues arising from or related to such noncompliance.

Modification of Terms

We may modify these API Terms at any time. Modifications will become effective immediately upon notice to you (which such notice includes posting on the America’s Health Rankings website). You should review these API Terms periodically. Your continued use of the API after modifications have been posted will constitute your acceptance of the modifications.
